帮教未成年罪犯的理论基础是儿童最佳利益原则、国家亲权原则和恢复性司法理念。对未成年罪犯实施帮教,是人民法院参与社会管理创新的政治要求和能动司法理念下人民法院审判职能的延伸。未成年罪犯帮教中存在立法不完善、帮教形式单一、帮教力量不够强大等问题。人民法院应通过社会调查、刑事和解、圆桌审判、前科档案封存、心理疏导、回访考察等形式构建未成年罪犯帮教体系。
The theoretical basis for teaching juvenile offenders is the principle of the best interests of children, the principle of national parental authority and the concept of restorative justice. The help and education of juvenile criminals is an extension of the people’s court’s political requirements for participating in social management innovation and the trial function of the people’s court under the concept of active judicial work. Juvenile criminals help teach the existence of imperfect legislation, to help teach a single form, to help teach the power is not strong enough and so on. The people’s court shall construct a system of helping and teaching minors by means of social investigation, criminal reconciliation, round table trial, archival archival records, psychological counseling, and return visits.
