近年来,发展中国家越来越多采用国际商事仲裁作为处理纠纷的方式,但国际商事仲裁正在逐渐脱离发展中国家法院的监督和控制。传统观点所认为的商事仲裁的效率性等特征并不能保障发展中国家的权益。仲裁员享有广泛的自由裁量权和法院对仲裁程序的有限干预更加恶化了发展中国家在国际商事仲裁中的地位。亚非法律协商组织倡导设立的区域性仲裁中心有助于维护发展中国家在国际商事仲裁中的权益,值得借鉴。
In recent years, developing countries have increasingly adopted international commercial arbitration as a way of handling disputes, but international commercial arbitration is gradually being out of the control and supervision of courts in developing countries. The traditional view that the features of the efficiency of commercial arbitration does not guarantee the rights and interests of developing countries. The broad discretion of arbitrators and the limited court intervention in arbitral proceedings have further exacerbated the status of developing countries in international commercial arbitration. The regional arbitration center set up by the Asian-African Legal Consultative Organization helps to safeguard the rights and interests of developing countries in international commercial arbitration and is worth learning from.
