随着我国法律制度的不断完善,渎职犯罪问题也成为许多学者研究的重要内容。尤其现阶段在渎职犯罪司法中对存在的主要疑难问题已逐渐明确,包括如何认定犯罪主体、如何判定重大损失、共犯以及渎职所带来的危害等,要求逐渐在相关法律方面不断完善以解决存在的疑难问题。本文主要对渎职犯罪主体的基本概述、如何从司法角度对重大损失在渎职犯罪中的表现进行认定、案件发生的因果关系以及共同犯罪在渎职行为中的认定等进行探析。
With the continuous improvement of our legal system, the problem of dereliction of duty has also become an important part of many scholars’ research.
