案由:杨××,男,现年25岁,1997年在交通大学完成研究生学业后,受聘于本市某外商独资企业工程部,该外资企业为此向交通大学支付了7000元人才培养费。杨××报到上班当天,企业与其签订劳动合同。杨××发现企业提出的劳动合同文本中所列条款与招聘面试时看到的合同文本有多处作了修改,感到合同有诈,但因刚刚毕业,求职心切,便签下了这份为期三年的劳动合同。合同约定:杨××月薪1600元人民币;如果不按合同规定提前离开单位,须向企业赔偿双倍培养费1.4万元。
