Q我公司(上海)即将有一部分员工第二次固定期限劳动合同期满,公司只打算与其中一部分员工到期续签。请问,其余员工可以终止合同吗?A依据《劳动合同法》的有关规定,如果用人单位需要与这类员工续订劳动合同,除劳动者提出订立固定期限劳动合同外,都应当订立无固定期限劳动合同。但是,对于期满时是否能够终止,依据上海市高级人民法院《关于适用<劳动合同法>若干问题的意见》的要求,用人单位与劳动者在是否续订第三次合同
