在我国《商标法》已实施三十余年之际,再次通过法律理论的层面进行学术探讨是非常有必要的。三十余年来,我国的内外商业环境都已经发生了翻天覆地的变化,商业产权意识,商标保护意识都在不断加强,在目前商业侵权案例逐渐增多的今天,如何进行好商业名称与商标保护的对接性是各级有关部门面临的一个新课题。针对现有的商业商标保护案例,应当从整个司法保护高度进行系统化、理论化分析,同时还应当对已经提供的保护对接性进行进一步的宏观思考。本文通过一些具体理论与案例相结合,相信一定可以给读者一些启示。
At a time when China’s “Trademark Law” has been implemented for more than 30 years, it is necessary to conduct academic discussions again through the level of legal theory. Aiming at the existing cases of commercial trademark protection, we should conduct a systematic and theoretical analysis from the perspective of judicial protection.
