比较我国内地与香港、澳门、台湾地区~①承认及执行外国仲裁裁决的制度,并研究了内地与港澳地区在“一国两制”实现前后相互执行仲裁裁决以及内地与台湾地区相互认可和执行仲裁裁决的法律规定及实践,1958年《纽约公约》可资借鉴以统一我国区际仲裁裁决的执行。内地与港澳地区之间实际上采纳了《纽约公约》的实质内容,但内地与台湾地区之间则彼此把对方的裁决视为既非外国裁决也非本地裁决的第三类裁决,显然不利于提高两岸之间的执行效率。两岸应正视这一问题,改变观念。在此基础上,统一我国的区际仲裁裁决执行制度,使仲裁更好地服务于四地间的商务交流。

The substance of the New York Convention has actually been adopted between the Mainland and Hong Kong and Maucao regions. However, treating each other’s ruling as a third type of ruling, which is neither a foreign decision nor a local ruling, is obviously unfavorable to the Mainland Improve the efficiency of cross-Strait implementation. Both sides of the strait should address this issue and change their concepts. On this basis, we should unify the enforcement system of interregional arbitral awards in our country so that arbitration can better serve the business exchanges among the four places.
