农村土地的规模化和专业化经营成为不可阻挡的趋势。其中土地的抵押问题值得大家探讨和研究。土地的抵押一方面为实现农业的规模化和专业化提供了大量的耕地资源;另一方面也为农户提供了获取资金的渠道。但是运作中也暴露出诸多问题:许多金融机构不愿意接受土地作为抵押物;抵押后农户无力偿还抵押贷款导致丧失农地使用权等等。我们应该通过健全法律来规范农地抵押这种方式,尝试建设一种新型农业土地流转模式。
Large-scale and specialized management of rural land has become an irresistible trend. One of the land mortgage issues worth exploring and research. On the one hand, the mortgage of land provides a large amount of cultivated land resources for the realization of the scale and specialization of agriculture; on the other hand, it also provides farmers with channels for obtaining funds. However, many problems have emerged during the operation. Many financial institutions are reluctant to accept land as collateral. After the mortgagor fails to repay the mortgage loan, it will result in the loss of the right to use agricultural land. We should try our best to establish a new mode of agricultural land circulation by regulating the law of farmland mortgage through sound laws.
