优劣性审查机制的引入是澳大利亚行政法领域自1970年代以来最为重要、最具革新性,也是最有争议的制度改革。由行政上诉裁判所进行的优劣性审查旨在弥补司法审查的缺憾,为行政相对人提供“公平、合理、经济、非正式和快捷”的行政救济,并帮助行政机关做出“更正确或更完美”的行政决定。梳理和研究澳大利亚优劣性审查机制,对于我国行政复议制度的改革具有一定的启发和借鉴意义。
The introduction of a merit-based review mechanism is the most important, innovative and controversial institutional reform in Australian administrative law since the 1970s.
