条约解释是国际法的核心。本文考察时际原则及其在条约中的适用、条约法的起草历史、哲学释义学的相关概念,结合国际法院和WTO争端解决机构的实践,就条约解释的演化性作初步的探讨,认为演化、演变或当下解释,是时际原则在条约解释中的体现;演化解释重要内核是体系性,体系演化解释是国际法发展的内在、本质要求。以此为基础,根据体系演化解释要求,对WTO专家组新近就“中国原材料出口限额案”所作裁决提出了思考。
Treaty interpretation is the core of international law. This article examines the principle of intercity and its application in treaties, the history of the drafting of the law of treaties and the related concepts of philosophical hermeneutics. Based on the practice of the International Court of Justice and the WTO Dispute Settlement Body, this paper makes a preliminary discussion on the evolution of treaty interpretation, , Evolution or current interpretation is the embodiment of the inter-temporal principle in the interpretation of the treaty. The important kernel of the evolutionary interpretation is the systematicness and the evolutionary interpretation of the system is the intrinsic and essential requirement of the development of international law. On the basis of this, based on the requirements for the evolution of the system, the WTO Panel of Experts recently put forward some reflections on the “China’s export quota of materials”.
