南斯拉夫1974年宪法和联邦立法所规定的南斯拉夫现行司法体系,一部分是以1946年新南斯拉夫的初期宪法结构所规定的原则为依据。这些原则与欧洲一切真正民主国家的大陆法的司法原则相同,所以本文只作简要的叙述,而着重介绍那些由于政治制度的发展而不可避免地出现的新事物,以及与传统法院的进一步发展有关的问题。
The Yugoslav judicial system, as laid down in Yugoslavia’s 1974 constitution and federal legislation, is based in part on the principle laid down in the initial constitutional structure of 1946 in the former Yugoslavia. These principles are the same as the judicial principles of civil law in all genuinely democratic countries in Europe.
