长期以来,对于专利权人或被许可人作出明示的限制条件或附条件销售能否排除专利权穷竭原则的适用这一问题,美国法院一直没有作出明确的规定,导致专利权人对使用或转售专利产品的售后限制条款引发了很多争议。文章通过论述美国专利权穷竭原则的历史及内容,结合Impressionv.Lexmark的案件判决和评价,探究美国专利权穷竭原则的新发展,以此解决专利权穷竭原则的适用问题。
For a long time, the United States courts have not made any explicit stipulations on whether patent holders or licensees should make express restrictions or whether conditional sales can rule out the application of the principle of exhaustion of patents. As a result, patent holders’ After-sales restrictions on the sale of patented products triggered a lot of controversy. By discussing the history and content of the principle of exhaustion of the patent in the United States, the article explores the new development of the principle of exhaustion of the patent in the United States in light of Impressionv. Lexmark’s judgment and evaluation of the case, in order to solve the problem of the application of the principle of exhaustion of patent rights.
