《最高人民法院关于适用<中华人民共和国婚姻法>若干问题的解释(三)》(以下简称《解释三》)于2011年8月13日起施行。这份司法解释内容包括房屋产权归属、生育权、婚内财产分割等热点问题。在社会上引起了热烈反响和广泛讨论,促使人们开始重新审视和思考婚姻与家庭的权利与责任。本文分析了该司法解释出台的背景,通过对真实案例的剖析,详细解读了该司法解释的突破和创新,并提出了该司法解释可能会引起的积极意义。
“The Supreme People's Court on Several Issues concerning the Application of the Marriage Law of the People's Republic of China (III)” (hereinafter referred to as “Interpretation III”) came into force on August 13, 2011. The contents of judicial interpretation include the ownership of property rights, reproductive rights, marital property division and other hot issues. In the community has aroused enthusiastic response and extensive discussion, prompting people to start re-examine and think about the rights and responsibilities of marriage and family. This paper analyzes the background of the introduction of judicial interpretation. Through the analysis of the real case, this article explains the breakthrough and innovation of the judicial interpretation in detail and puts forward the positive meaning that the judicial interpretation may bring.
