案例2012年夏,A公司依法取得某块土地建设用地使用权。在办理完报建手续后,进行了写字楼建设,并完成外装修。该写字楼为15层高。当年10月8日,A公司将这栋写字楼的第11至第15层卖给了B公司,并约定半年后交房,B公司于交易次日申请办理了预告登记。然而一周后,A公司因为还款需要,在B公司不知情的情况下,以该写字楼第11至第15层设立抵押,向银行借款。后固资金周转持续遇到困难,又将该写字楼第1至第10层设立抵押,向银行借款。2013年1月5日,
