律师代理在民事诉讼中已经被广大公众所熟知,作为诉讼当事人的诉讼代理人,律师以其专业的法律知识为当事人提供帮助,辅助其进行诉讼过程,促进其诉讼权利的实现。律师代理的地位和作用与民事诉讼的进行,尤其是民事诉讼模式有重要的关系。本文试从律师在民事诉讼中的代理人角色,律师代理与民事诉讼模式、法官的释明权的关系分析律师代理的作用,并进一步对强制律师代理制度做一个简要分析。
As a litigant’s agent and lawyer, the lawyer’s agent has been well known to the general public in civil litigation. With its professional legal knowledge, the lawyer helps the litigant to assist the litigant in litigation process and promote the realization of litigation right. The status and role of the lawyer’s agent have an important relationship with the proceeding of the civil lawsuit, especially the civil litigation mode. This article tries to analyze the role of lawyer’s agent from the lawyer’s role in the agent of civil lawsuit, the lawyer’s agent and the civil litigation mode, and the judge’s right of interpretation. And it also makes a brief analysis of the lawyer’s agent system.
