在中国延续半个世纪之久的劳教制度戛然而止,使得与劳教制度同生的劳教部门也面临诸多的现实困境。更好地对原劳教场所和工作人员进行角色与职能的转换,使人尽其能,物尽其用;对原劳教人群进行分流处理,使违法行为得到应有而适当的制裁,实现法的教育功能,这些问题都需要我们在实践中不断探索。对这些问题的适当处置,对节约行政成本、实现社会资源最大化利用以及社会的和谐发展都具有现实意义。
The system of re-education through labor that lasted for more than half a century in China has come to an abrupt end, making the re-education and labor departments that share the same birth with the system of labor camps also facing many difficulties in reality. To better perform the conversion of the roles and functions of the former places of re-education and staff, to make the best use of their talents and resources; to divert the former labor-education population so that the illegal acts can be properly sanctioned and realized Educational functions, these issues require our continuous exploration in practice. Proper disposal of these issues is of practical significance for saving administrative costs, for maximizing the utilization of social resources and for the harmonious development of society.
