制定一部中国行政程序法,已成共识。对于制定行政程序法要不要以宪法为基础,中国宪法能否作为基础,又如何作为基础的问题,则众说纷纭,莫衷一是。探究历史可以发现,制定行政程序法需要宪法基础,没有宪法的成功实践,没有对宪法价值的广泛认同,行政程序法就不会成为一种需求,也不会成功制定。随着对行政权运作要求的提高,宪法文本及其所体现的价值必然要被激活,最终要在宪法成功实践所形成的社会基础之上制定出行政程序法来。宪法为行政程序法的制定提供正当性的基础,同时又控制着行政程序法的制定,使其不至于偏离宪法的要求。中国宪法的规定和价值及其实践也正在为行政程序法提供基础。它重视对人权的保障,也重视程序对人权保障的作用,它还为行政程序法诸多原则提供了依据。满足这些要求,才可以构成行政程序法正当性的基础。
The formulation of a law on administrative procedures in China has become a consensus. There are a lot of different opinions and different opinions on whether or not the administrative procedural law should be based on the constitution and whether the Chinese constitution can serve as the basis or not. To explore history, we can find that the formulation of administrative procedural law requires the constitutional foundation. Without the successful practice of the constitution and the lack of broad recognition of the value of the constitution, administrative procedural law will not be a demand nor will it be successfully enacted. As the requirements for the operation of the executive power increase, the text of the Constitution and the value it embodies must inevitably be activated. Finally, the Administrative Procedure Law should be formulated on the basis of the social foundation formed by the successful practice of the Constitution. The Constitution provides the foundation for the formulation of the Administrative Procedure Law and at the same time it controls the formulation of the Administrative Procedure Law so as not to deviate from the requirements of the Constitution. The provisions, values and practices of the Chinese constitution are also providing the basis for the Administrative Procedure Law. It emphasizes the protection of human rights and attaches importance to the protection of human rights by the procedure. It also provides the basis for many principles of administrative procedure law. Satisfying these requirements can form the basis of the law of administrative procedure.
