善意取得制度是我国吸收借鉴德国民法典的物权制度并逐步发展完善的一项特殊的物权变动规则,它突破了立法者对所有权排他的全面性保护,允许第三人在合理信赖公示信息的情况下善意接受出让人的无权处分,取得本属于原权利人的所有权。尽管物权法第一百零六条对动产和不动产善意取得做了统一规定,但实际上基于不动产自身的性质,其善意取得的构成独具特点,本文将通过要件分析的方式对其展开讨论。
