法律原则的存在是已然的事实,对其功能的探讨有助于我们更好的发挥其作用。法律原则可以把不同的法律条文组合成一个系统化的有机整体,并能彰显其意义脉络;法律原则可以为法律规则的适用提供指导,对法律规则乃至整个实在法进行评价,填补法律规则漏洞;还可以为法院处理各种法律纠纷提供标准,并对法官的自由裁量作出合理的限定;最终能维护法治统一,促进社会和谐发展。
The existence of the legal principle is already a fact, and the exploration of its function helps us to play its role better. The principle of law can combine different legal provisions into a systematic and organic whole, which can reveal its significance. The principle of law can guide the application of legal rules, evaluate the legal rules and the whole real law, and fill in loopholes in legal rules. It can provide standards for courts to handle various legal disputes and make reasonable restrictions on the discretion of judges. Ultimately, it can safeguard the unification of the law and promote the harmonious development of society.
