Karl P.Sauvant教授领衔的E15倡议投资政策特别工作组在《演进中的国际投资法律与政策体制:未来路向》一文中为我们描绘出一个国际投资法制的社会化改革路径。这一改革路径的选择缘于现有国际投资法制忽视国际投资的社会属性,对东道国与国际社会的社会利益关切回应不足。因此,未来的国际投资法制改革应在兼顾不同利益相关者的利益的基础上,引入特殊与差别待遇,构建全球共识,以期构建一个公平、透明、稳定和有效的全球性国际投资法律体制。
The E15 Initiative Investment Policy Task Force led by Prof. Karl P.Sauvant portrays us a path to socialization of the international investment law system in his article entitled “The Evolving International Investment Law and Policy Structure: The Way Forward.” The choice of this reform path stems from the fact that the current international investment law neglects the social attributes of international investment and responds insufficiently to the social interests of the host country and the international community. Therefore, the future reform of international investment law should take into consideration the interests of different stakeholders, introduce special and differential treatment and build a global consensus so as to establish a fair, transparent, stable and effective global legal system for international investment.
