从法律语言学的角度来说,法律和法庭制度的实践,是一个广义的话语和会商过程。把握法律和法庭的话语特征,尤其是非正式话语在实际的法律和法庭活动中的作用,对于我们理解和把握法律和法庭在具体的实践过程中的复杂性具有重要的意义。本文结合具体的案例讨论英美法系中法官席前会商的内涵、形式、特征,并着重论述非正式话语在法庭话语和会商过程中产生的作用及其合理性的问题。
From the perspective of legal linguistics, the practice of law and court system is a broad process of discourse and consultation. Grasping the legal and court discourse features, especially the role of informal discourse in the actual law and court activities, is of great importance to us in understanding and grasping the complexity of the law and courts in their concrete practice. This article discusses the connotation, form and characteristics of the pre-judge consultations in Anglo-American legal system based on the specific cases and focuses on the function and rationality of informal discourse in courtroom discourse and consultation.
