Comment Xin: Article 115 of the “Contract Law of the People’s Republic of China” stipulates that parties may, in accordance with the Guarantee Law of the People’s Republic of China, stipulate that one party pays the other party a deposit as a guarantee of its claim. After the obligor performs his obligation, the deposit shall be refunded or recovered. The party that pays the deposit fails to fulfill the agreed debts and is not entitled to claim the return of the deposit; if the party who receives the deposit fails to perform the agreed debts, the deposit shall be doubled.
