一、自裁管辖权概述(一)自裁管辖权的由来和特点自裁管辖权是指仲裁庭在当事人对仲裁协议的效力以及仲裁庭的管辖权有异议时,有权对仲裁协议的效力和仲裁庭是否拥有管辖权作出决定。易言之,就是当当事人对仲裁协议效力以及仲裁管辖权提出异议时,仲裁庭有权决定其自身是否具有管辖权。
