本文通过对国内纺织服装企业的调查,概括描述了我国超时劳动问题的现状特点,并详细考察不同行动主体在超时劳动问题上的微观互动机制。研究发现地方政府与企业的微妙互动关系,普通工人与企业之间的强制与同意,跨国资本对本土企业的社会责任要求与逐利要求等若干机制共同塑造了我国超时劳动问题的现状。在上述微观互动机制中,对超时劳动问题进行抑制的机制作用虽然十分有限,但这些机制的出现却预示了改善劳工权益的可能途径。
Based on the investigation of domestic textile and apparel enterprises, this paper summarizes the current situation and characteristics of China's overtime labor issue and examines in detail the micro-interaction mechanisms of different actors on overtime labor issues. The study finds that the subtle interaction between local government and enterprises, the compulsion and agreement between ordinary workers and enterprises, the social responsibility requirements of transnational corporations for local enterprises and the profit-seeking requirements of local enterprises jointly shape the status quo of overtime labor in our country. Although the mechanism for restrain the overtime labor issue is very limited in the above micro-interactive mechanism, the emergence of these mechanisms foreshadows the possible ways to improve the labor rights.
