从传统意义上来看,中国人的婚姻,对个人最大的改变在于两个人的财产合二为一。但《婚姻法》的新规定使得这一传统的模式被打破:2010年颁布的新《婚姻法》司法解释规定:婚前个人财产不因为婚姻的存续转化为共同的财产。这也就是取消了原司法解释:婚姻存续八年,婚前个人财产(房产)作为共同财产的规定。新的规定一出台,就引发了众多争议和家庭纠纷……
In the traditional sense, the biggest change in marriage and personalization for Chinese people is the combination of the two people's property. However, the new provisions of the Marriage Law made this traditional model broken: Judicial interpretation of the new Marriage Law promulgated in 2010 stipulates that personal property before marriage will not be transformed into common property because of the existence of a marriage. This is the abolition of the original judicial interpretation: the marriage lasts for eight years and pre-marital personal property (real estate) as common property requirements. As soon as the new rules were introduced, many controversies and family disputes have been triggered.
