在国家动员式的发展战略下,互联网医院呈现出蓬勃发展之势,存在各种探索模式和实践样态。笔者认为,从法律实务的角度出发,以互联网医院为例的健康医疗领域互联网应用,需要厘清概念,区分类型,进而分析其在发展过程中可能面临的法律风险。具体地,包括项目运营前期资质证照的法律风险,项目运营中期信息数据管理的法律风险,项目运营中后期多元办医格局下潜在纠纷的法律风险。只有明确自身定位,了解监管规则以及防范法律风险,才有可能实现互联网与医疗健康之间的深度融合。
Under the national mobilization strategy, internet hospitals are booming. There are various modes of exploration and practice. The author believes that from the perspective of legal practice, Internet applications in the field of health and medical care, such as Internet hospitals, need to clarify concepts and distinguish types, and then analyze the legal risks they may face in the development process. Specifically, it includes legal risks of pre-qualification qualification of the project operation, legal risks of data management of mid-term operation of the project, and legal risks of potential disputes under the pattern of diversified medical operations in the latter part of the project operation. Only by clearly positioning itself, understanding regulatory rules and guarding against legal risks, will it be possible to achieve a deep integration between the Internet and health care.
