电子政务的建设与发展改变了传统的行政模式,提高了行政效率,也给行政相对人提供了便利。与此同时也给传统的法学理论带来了挑战,不仅是与电子政务关系密切的行政法学受到挑战,刑法、民法等法律部门传统理论都应该进行变革,如何使相关法律部门与电子政务相适应进而促进行政电子化、信息化的进一步发展是亟待解决的重大课题。阐述了当前电子政务涉及的行政法问题,以及由此带来的挑战和影响;论述了电子政务中的刑法问题;讨论了电子政务中的民法问题,以及现行《民法》中相关规定所应做出的适应变革。
