我国《劳动法》等有关法规明确规定,各类企业包括私营企业,均应与雇员签订劳动合同,并为其缴纳社会保险。然而在现实中,真正履行这一强制义务的并不多见。权益受到侵害的个人相对于企业来说,处于弱势,职工个人往往敢怒不敢言。因为稍有不满,企业领导尤其是私营企业主便横加指责,甚或以解雇相威胁。考虑到利害得失,个人只得忍气吞声地接受,以防因小失“大”。
China’s “Labor Law” and other relevant laws and regulations clearly stipulate that all types of enterprises, including private-owned enterprises, should sign labor contracts with their employees and pay social insurance for them. However, in reality, it is rare to actually fulfill this compulsory obligation. The rights and interests of infringed individuals relative to the enterprises, in a weak position, employees often dare to say anger. Because of a little bit of dissatisfaction, business leaders, especially private entrepreneurs, blame them altogether, or even threaten the dismissal. Taking into account the gains and losses, individuals have to embitle to accept, to prevent the loss of “big.”
