法院主导创建“无讼社区”的实践是中国司法的新形态。“无讼社区”的实践具有合理性。司法推动“无讼社区”建设符合司法原理和纠纷解决原理。基层法院作为“无讼社区”建设主体既是应对社区法治资源短缺的需要,也是社区法治社会化和实现政治动员的需要。“无讼社区”未来发展应分三步走,终极目标是实现社区自治,法院变主动为被动,成为“无讼社区”建设的保障者。
The practice of court-led creation of “non-litigation community” is a new form of Chinese judiciary. “Non-litigation community ” practice is reasonable.
