1989年4月4日,第七届全国人大二次会议审议并通过了《中华人民共和国行政诉讼法》。该法于同日以国家主席令的方式公布。第二天,本刊编辑部和北京大学法律系行政法教研室联合召开了行政诉讼法座谈会,到会的有北京大学、中国人民大学、中国政法大学、社科院法学研究所、中国人民公安大学、中央民族学院等大专院校的教授、学者,以及全国人大常委会法工委、最高人民检察院、北京市人大常委会、北京市人民法院的有关员责同志。参加会议的还有人民日报、法制日报、《中国法学》杂志的有关同志和有关大专院校的青年教师及研究生,共五十多人。座谈会发言踊跃、各抒己见,展开了热烈讨论。现将蒋朝阳同志整理的座谈会部分发言发表如下,以飨读者。
On April 4, 1989, the Second Session of the Seventh National People’s Congress examined and passed the Administrative Procedure Law of the People’s Republic of China. The law was promulgated on the same day by way of a Presidential Decree. The next day, the editorial department of Peking University and Peking University Law Department of Administrative Law jointly held a forum on administrative procedure law, to attend the Peking University, Renmin University of China, China University of Political Science and Law, Institute of Law, CASS, Chinese People’s Public Security Professors and scholars from colleges and universities, such as the Central Government Institute of Nationalities, as well as relevant responsible comrades and comrades of the Legal Work Committee of the NPC Standing Committee, the Supreme People’s Procuratorate, the Beijing Municipal People’s Congress and the Beijing Municipal People’s Court. Also participating in the meeting were People’s Daily, Legal Daily, relevant comrades of China Law Journal and young teachers and graduate students from relevant tertiary institutions, totaling more than 50. The forum spoke enthusiastically, express their views, launched a lively discussion. Now part of the symposium organized by Comrade Jiang Chaoyang delivered the following speeches to readers.
