“执法打架”、“职能交叉”、“权限争议”诸如此类的词语见诸报端的频率愈来愈高,直观的表现了现时政府职能部门之间权限冲突的普遍性和严重性。政府职能部门之间权限的冲突,影响了行政机关日常行政工作效率的提高,破坏了政府在公民心目中的公信力,削弱了政府的地位和权威,严重损害了公民的合法权益。大部制改革在短期内取得了一定的成效,但是这场自上而下的改革并未完全朝着人们的愿景进行。究其原因,行政机关的权限冲突并不仅仅是一个行政体制问题,更多的是一个法律问题,一个行政法、行政组织法问题。笔者希望能在大部制改革的基础之上,着重从法律层面分析行政权限争议问题,希冀能为中国行政冲突的合理解决尽自己的绵薄之力。
“Law enforcement fights ”, “function cross ”, “authority controversy ” and other such words appear more frequently at the newspaper, an intuitive expression of the prevalence of authority conflicts between the current government departments of the universality and serious Sex. Conflicts of authority between government departments have affected the efficiency of administrative agencies in daily operations, undermined the credibility of the government in the eyes of citizens, weakened the status and authority of the government, and seriously damaged the legitimate rights and interests of citizens. Most reforms have achieved some success in the short term, but the top-down reform has not been completely carried out toward the people’s vision. The reason, the administrative authority of the conflict of authority is not just an administrative system, more of a legal issue, an administrative law, the issue of administrative organization law. Based on the reform of most departments, the author hopes to analyze the issue of administrative power disputes from the perspective of law in the hope of making a modest contribution to the reasonable settlement of administrative conflicts in China.
