集资建房在我国作为福利分房到自由买卖商品房的一种过渡形式,是职工享受房改优惠政策的有效途径。随着经济社会的不断发展,集资房的买卖活跃,交易量持续增加,由此引发的诉讼也愈发增多。集资房买卖合同的效力是其中的基础性问题,确认其效力,规制其交易流程,对于促进房地产市场稳定健康发展具有积极的意义。
