通过对历史上有关受教育权性质四种学说的研究,提出了受教育权在本质上是宪法权利,兼有自由权与社会权双重性质,同时受教育权又是公民应该享有的法律权利。
Through the study of the four theories concerning the nature of the right to education in history, it is proposed that the right to education is essentially a constitutional right with the dual nature of freedom and social rights. At the same time, the right to education is the legal right that citizens should enjoy.
