身份权精神内涵的实质是主体基于特定身份可当然期待的良性情感状态,较为典型的情感类型包括亲情之爱、情爱、荣誉感。丰富身份权的精神利益内涵,符合现代民法主体理论发展的总体趋向,回应了我国婚姻家庭生活关系的现代性发展状况,利于倡导全面健康的养老育儿观念和弥补社会保障体系的不足。应以精神抚慰为最高意旨,修正和完善我国现行物质主导型的身份权精神利益保护制度体系,树立身份权精神利益内涵应有的法律地位。
The essence of the connotation of the spirit of identity right is the benign emotional state which the subject can of course look forward to based on a specific identity. The more typical types of emotion include affection, affection and sense of honor. The connotation of enriching the spiritual interests of the right of identity accords with the general tendency of the development of the main theory of modern civil law and responds to the modern development of the marriage and family life in our country and promotes the idea of a comprehensive and healthy retirement and raising children and makes up for the deficiency of the social security system. We should use the spirit to soothe the highest intent, amend and perfect the current system of substance-oriented system of protecting the spiritual interests of the status right, and establish the due legal status of the spiritual interests of the status right.
