【案情回顾】2006年3月开始,小唐进入星光模具公司工作,先后担任公司职员、计划科科长。公司规定:“员工在职期间生产、经营与公司有竞争的产品,属情节严重,应解除双方劳动关系,予以辞退”。2011年1月,小唐与星光模具公司签订保密协议一份,约定:合同期2年,自2011年1月4日起至2013年1月3日止;小唐不得生产、经营星光模具公司竞争产品;违反本协议,公司有权无条件解除
【Case Review】 Since March 2006, Xiaotang has entered into the work of Xingguang Mold Company, successively serving as the staff member and chief of the planning department. The company provides: “Employees during the production and operation of products competing with the company, is a serious case, the labor relationship should be lifted, be dismissed.” In January 2011, Xiaotang signed a confidentiality agreement with Starlight Mold Co., Ltd., which stipulated that the contract period will be 2 years from January 4, 2011 to January 3, 2013. Xiaotang may not manufacture or operate Starlight Mold Co. Competition products; violation of this agreement, the company reserves the right to lift unconditionally
