农村土地承包经营权转让关涉到各方的巨大利益,一直以来学理上和立法上都有诸多积极探讨。本文以近年来的司法判决书为对象,以承包经营权转让合同的效力为切入点,对司法判决书中揭示的若干问题进行分析,以期解决相关的法律适用问题,正确解释《土地承包法》中对承包权转让的强制规定,探讨这些强制规定能否影响承包权转让合同的效力。本文研究认为,改变土地所有权性质和用途的强制性规定将导致转让合同的无效;违反法定的书面形式要求会影响到合同的效力,但是可以通过履行行为对形式瑕疵进行补正:未经发包方的同意并不必然导致转让合同的无效:转让方和受让方资格的限制属于不当限制,一般情况下也不影响转让合同的效力。为了使土地承包经营权这一用益物权发挥最大的经济效益,应该理性认识承包经营权的转让行为。
The transfer of rural land contractual management rights involves the great interests of all parties. There have been many positive discussions both in theory and in law. This article takes judicial judgments in recent years as the object, analyzes the problems revealed in the judgments by analyzing the validity of contract of contractual right transfer, with a view to resolving the problems related to the application of law and correctly interpreting the The right to contract the transfer of the mandatory provisions to explore whether these mandatory provisions can affect the effectiveness of the contract of assignment of the contract. However, the formal defects may be corrected through the performance of the contract: The consent does not necessarily lead to the invalidation of the transfer contract: restrictions on the qualifications of the transferor and the transferee are unduly restrictive, and generally do not affect the validity of the contract of assignment. In order to maximize the economic benefits of the usufructuary right of the land contractual management right, we should rationally understand the transfer of the contractual management right.
