无罪推定原则是刑事诉讼中的一个重要的人权保障原则,它以保障被告人的权利为最高价值追求。民主和法治是无罪推定原则的政治伦理基础,司法公正是无罪推定原则的程序伦理基础。无罪推定原则要求刑事诉讼中的侦查权、控诉权、审判权的运作必须以保障公民的权利为出发点。为了保证公民的权利免受国家权力的侵害,刑事诉讼必须实行无罪推定原则。
The principle of presumption of innocence is an important principle of human rights protection in criminal procedure. It pursues the highest value by safeguarding the rights of the accused. Democracy and the rule of law are the political and ethical bases of the principle of presumption of innocence, and judicial fairness is the procedural ethical foundation of the principle of presumption of innocence. The presumption of innocence requires that the operation of the investigative, prosecutorial and judicial powers in criminal proceedings must be based on the protection of citizens’ rights. In order to ensure that citizens’ rights are not violated by the state power, criminal proceedings must implement the principle of presumption of innocence.
