《劳动合同法》实施以来,在劳务派遣方面存在一些不够明确、不易操作、认识分歧的问题,同时对派遣单位和用工单位在人力资源管理方面都造成了一定的影响,派遣单位和用工单位应该对此予以充分认识、积极应对,使劳务派遣制度对企业的发展发挥最佳效益。《劳动合同法》还应该在明确法律术语的涵义方面作进一步的完善,以利于法律的实施,方便管理部门执法,也方便企业执行法律制度。
