学术界对社会救助的制度建设和实践状况已有多方面研究,有的从非法学的如公共管理、经济、社会等方向对某一类社会救助活动如何实施所进行的实务性研究~1,有的从理论法学、比较法学以及社会法学的方向对某一种现象或者某一类特殊主体如何进行社会救助制度建设进行专项研究或者历史研究~2。也有学者从理论层面对社会救助的立法理念、技术层面对社会救助法与社会保险法的衔接问题进行了研究~3。本文试图阐明社会救助立法中应当考虑的几个技术性问题,力图使社会救助立法更加科学,从而提升未来《社会救助法》的可操作性。
The academic community has studied many aspects of the system construction and practice of social assistance. Some studies have been carried out from the perspectives of public administration, economy and society on the implementation of certain types of social assistance activities. Some from the theoretical jurisprudence, comparative law and social law direction for a particular phenomenon or a particular type of social subject how to carry out social assistance system to conduct a special study or historical study ~ 2. Some scholars have also studied the legislative concept of social assistance at the theoretical level and the connection between the social assistance law and the social insurance law at the technical level. This article attempts to clarify several technical issues that should be considered in the legislation of social assistance so as to make the social assistance legislation more scientific so as to enhance the maneuverability of the future Social Assistance Law.
