刑事政策学应从刑法学、政治学、社会学等多学科研究理论出发,准确把握刑事政策的涵义与特点,为国家提供适合国情、体现时代精神的、科学的、合理的刑事政策。传统的刑事政策因所处历史背景的局限,在研究视野和结构体系上有很大的缺陷,应予以变更、补充和完善。建立以“德主刑辅、打防并举、轻轻重重、宽严相济”为核心内容的现代刑事政策体系,对于和谐社会建设具有重要意义。
Criminal policy should start from the multidisciplinary research theory of criminal law, political science and sociology, accurately grasp the connotation and characteristics of criminal policy, and provide the country with a scientific and reasonable criminal policy that suits the national conditions and embodies the spirit of the times. Due to the limitations of the historical background, the traditional criminal policy has great flaws in the field of study and structure and should be changed, supplemented and improved. It is of great significance to establish a modern criminal policy system with the core contents of “supporting the main punishment, striking off one by one simultaneously, gently, mercy and temper” as the core content.
