多元规范的格局是国家治理需要面对的社会事实。多元规范作为国家治理的资源,首先,基于法律是国家构建超时空秩序的基础性制度资源,成为国家用以结构化社会的基本力量。其次,社会性的规范是复杂社会中微观秩序来源的关键性因素,对日常秩序的形成具有基础性作用。而多元规范对国家治理形成挑战或阻碍则主要是源于两种情形,一是多元规范间的互动产生出冲突等意外后果,导致治理效能受损等难题。二是规范的多元性下降或不足,导致国家面对基层的日常秩序维护和社会问题时处于“孤立无援”的境地,治理效能低。国家的规范整合能力直接决定着多元规范是治理的资源还是挑战。当前国家治理中的规范整合面临三个主要任务,即国家正式规范的内部整合、法律与党规党纪的整合、国家对社会性规范的整合,并应注意整合的限度。
The pattern of pluralism is the social fact that national governance needs to face. Multiple norms as a resource for state governance, first of all, based on the law is the country’s basic resources to build a system of time and space-based order, become the country’s basic force to structure the society. Second, the social norms are the key factors in the origin of micro-order in complex society and have a fundamental role in the formation of daily order. The multiple norms of state governance to form a challenge or obstruction is mainly due to two situations, first, the interaction between multiple norms produce conflicts and other unintended consequences, resulting in governance effectiveness and other challenges. Second, the normative diversity declined or weakened, causing the country to be “isolated” in the face of daily routine maintenance and social problems at the grassroots level, with low governance efficiency. National normative ability to directly determine the diversity of governance is a resource or challenge. At present, the normative integration in state governance faces three major tasks: the internal integration of the formal norms of the state, the integration of laws and party rules and regulations, the integration of social norms by the state, and the limits of integration.
