随着经济环境的变化,我国现行的破产法律制度暴露出越来越多的问题,如:破产法律制度内部缺乏和谐统一,和解整顿制度不完善,缺乏积极的财产保全措施等等。但除此之外,破产法律制度的完善还受着市场发育程度及其他配套法律制度等更深层因素的制约。因此,加快市场经济的建设,建立完备的市场法律体系,是完善我国破产法律制度的前提。
With the change of economic environment, the current bankruptcy law system in our country exposes more and more problems, such as: the lack of harmony and unity within bankruptcy legal system, the imperfect system of reconciliation and rectification, the lack of active property preservation measures and so on. However, in addition, the improvement of the bankruptcy legal system is also constrained by the deeper factors such as market development and other supporting legal systems. Therefore, accelerating the construction of a market economy and establishing a complete market legal system are the preconditions for improving the legal system of bankruptcy in China.
