文章首先对庭审交际中不同类型的语言进行了对象语言与元语言的分类,指出法官的庭审主持语言具有元语言的性质,然后对法官的元语言使用进行了功能分类。在此基础上对法官主持语言在庭审交际过程与庭审实体中的作用与影响进行了话语分析。话语分析的证据表明,法官庭审主持的元语言使用会不同程度地影响到庭审交际的实体内容,从而妨碍人们对司法公正的看法。
The article first classifies the object language and the metalanguage for different types of languages in courtroom interlocutory. It points out that the judge’s presiding judge language has the property of metalanguage, and then classifies the judge’s metalanguage usage. On this basis, the discourse analysis of the role and influence of the judge’s presiding language in the process of trial interlocutory and court trial is carried out. Evidence from discourse analysis shows that the use of metalanguages presided over by judges in court may affect the substantive content of court interrogations to varying degrees, thus impeding people’s perception of justice.
