新修订的《行政诉讼法》规定了人民法院可对规章以下的行政规范性文件进行附带性审查,但是由于缺少合理的管理和调控,行政规范性文件呈现出制定和运用的不规范等情形。在对相关法条进行分析的基础上,找出行政规范性文件司法审查存在的主要问题、提出相应的解决路径,并立足于现行权力配置体系和司法体制改革,参考借鉴国外的理论和本国的实践经验,对司法建议的规范、司法审查的强度、全社会各个机关、团体与行政规范性文件司法审查的联动机制等具体问题进行探究,以构建适合我国实际需要的规范性文件司法审查机制。
The newly revised Administrative Procedure Law stipulates that the People’s Court may carry out an incidental examination of the administrative normative documents under the rules, but because of the lack of reasonable management and control, the administrative normative documents present irregularities in formulation and application. On the basis of the analysis of related laws and regulations, this paper finds out the main problems existing in the judicial review of administrative normative documents and puts forward corresponding solutions. Based on the current power allocation system and the judicial system reform, the author makes reference to the theories of foreign countries and their own countries Practical experience, probe into specific issues such as the standard of judicial advice, the intensity of judicial review, the linkage mechanism of judicatory review of various organs and groups in all social sectors and administrative normative documents so as to construct a regulatory review mechanism suitable for the actual needs of our country.
