土地规划是土地管理的重要手段,是实现土地资源合理配置的重要保障。从我国土地规划制度和运行的实践看,规划应有的法律地位并未树立,规划的功能也未能充分发挥。因此,赋予土地规划明确的“法律”位阶,以“市场”为导向配置土地资源,实现规划制定过程中利害关系人的有效参与,做到城市规划、环保规划与土地规划的协调统一,建立规划变更、废止的赔偿和补偿机制,将有利于实现土地规划的法治化。
Land planning is an important means of land management and an important guarantee for the rational allocation of land resources. Judging from the practice of China's land planning system and operation, the due legal status of planning has not been established and the functions of planning have not been brought into full play.
