《劳动合同法》的适用范围与原来的《劳动法》有什么区别呢?让我们先温习一遍《劳动法》第2条和1995年劳动部关于贯彻执行《〈中华人民共和国劳动法〉若干问题的意见》。《劳动法》的适用范围具体为:(1)各类企业和与之形成劳动关系的劳动者;(2)个体经济组织和与之形成劳动关系的劳动者;(3)国家机关、事业组织、社会团体实行劳动合同制度的以及按规定应实行劳动合同制度的工勤人员;(4)实行企业化管理的事业组织的人员;(5)其他通过劳动合同与国家机关、事业组织、社会团体建立劳动关系的劳动者。但排除了公务员和比照实行公务员制度的事业组织和社会团体的工作人员,以及农村劳动者(乡镇企业职工、进城务工和经商的农民除外)、现役军人和家庭保姆等。
