选取英国、美国和澳大利亚当前的数字资源长期保存活动为分析案例,研究这三个国家可适用于图书馆的著作权例外在图书馆数字资源长期保存方面的应用,剖析其存在的不协调性。指出数字资源的长期保存由于以下原因更需要图书馆享有合理的复制权例外:数字资源的保存需要多份复制件;数字资源长期保存中出现的软硬件老化;难以预见的老化;数字资源的生命周期与虚拟传播;数字资源保存需要建立一种动态的管理机制;数字资源长期保存需要采取联盟的方式实施。
The current long-term conservation activities of digital resources in the United Kingdom, the United States and Australia are selected as the analysis cases to study the application of the exception exceptions of the three countries to the long-term preservation of digital resources in libraries and to analyze their incompatibility. Pointed out that the long-term preservation of digital resources requires libraries to have reasonable reproductive rights for the following reasons: the preservation of digital resources requires multiple copies; the aging of hardware and software in the long-term preservation of digital resources; the unforeseeable aging; the life of digital resources Cycle and virtual communication. The preservation of digital resources needs to establish a dynamic management mechanism. The long-term preservation of digital resources needs to be implemented in an alliance manner.
