美国诱捕引渡中国公民的行为具有实质上的国际不法性。首先,诱捕引渡违反了国际法上的正当性原则,严重损害了中国主权和国家尊严等国际身份权益,也侵犯了被诱捕的中国公民的人权。其次,诱捕引渡背离了国际法的体系化要求,影响了国际社会的和谐发展。最后,为诱捕引渡提供协助的行为也构成了国际不法行为。为了解决国际引渡合作的各种困境,各国应充分协商与合作,重构“或引渡或起诉”原则,实现国际引渡合作上的良性发展。
It is a matter of international illegality that the United States traps the extradition of Chinese citizens. First of all, arresting and extraditing people violates the principle of legitimacy in international law, seriously undermining the rights and interests of international identities such as China’s sovereignty and national dignity, and violating the human rights of the captured Chinese citizens. Second, the trapping of extradition deviated from the systematic requirements of international law and affected the harmonious development of the international community. Finally, the act of providing assistance in the arrest of extradition also constitutes an internationally wrongful act. In order to solve various difficulties in international extradition and cooperation, all countries should fully consult and cooperate in reconstructing the principle of “extradite or prosecute” and achieve sound development in international extradition and cooperation.
