想要进一步保证民事证据排除规则的精准性、合法性以及可依据性,需要进一步明确非法证据排除规则。保证公民的基本权利是如今进行民事审判的基本目标。随着我国科学技术水平的不断提升,民事审判结构以及科技类型都有所变化,基于此应当充分融合司法审判实践技巧以及国外先进经验,形成新型民事诉讼非法证据排除规则。
If we want to further ensure the accuracy, legality and basis of civil evidence exclusion rules, we need to further clarify the rule of exclusion of illegality. Ensuring the basic rights of citizens is the basic objective of conducting civil trials today. With the continuous improvement of science and technology in our country, the structure of civil trial and the type of science and technology have all changed. Based on this, we should fully integrate the judicial trial practice skills and advanced foreign experiences to form a new type of exclusionary rule for illegal evidence in civil litigation.
