本文阐述了高校管理中的大学生受教育权利缺损。一方面分析了大学生受教育权利缺损的现状及原因,另一方面透视高校管理权行使中的问题及缺陷,最后结合上述分析,指出在协调两者的冲突上,应以关注大学生受教育权利的保护和对高校管理权行使的制约为问题解决的基点。在现行的高校管理权行使中要注意转变传统高校行政管理理念,建立完善有效的制约机制,从而保障大学生受教育权利。同时,要加强对大学生受教育权利的保护机制的完善,从而有效制约高校管理权并保障其合法有效地行使。
This article elaborates on the defect of college students’ right to education in college management. On the one hand, it analyzes the status quo and reasons of undergraduates’ right to education deficiencies, and on the other hand analyzes the problems and flaws in the exercise of the right of management in colleges and universities. Finally, combining the above analysis, it points out that in coordinating the conflict between the two, Protection and restriction of the exercise of administrative power in colleges and universities as the starting point for problem solving. In the current exercise of the management power of colleges and universities, attention should be paid to changing the concept of administration in traditional colleges and universities and establishing a perfect and effective restriction mechanism so as to guarantee the right to education of undergraduates. At the same time, it is necessary to improve the protection mechanism of college students’ right to education, so as to effectively restrict the management power of higher education institutions and ensure their legal and effective exercise.
